TERMS AND CONDITIONS OF THE DANTOR ONLINE STORE

  1. GENERAL PROVISIONS 1.1. The online store available at www.dantor.pl and www.dantor.com.pl is operated by Dantor FHU Torba Waldemar, Wola Mała 106, 37-100 Łańcut, NIP: 9222377046. 1.2. These Terms and Conditions define the rules for using the Store, placing orders, executing sales agreements, forms of payment, withdrawal from the contract, and the complaint procedure. 1.3. Customer – a natural person, legal person, or organizational unit with legal capacity making purchases in the Store. 1.4. Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity. 1.5. The provisions of Polish law apply to sales contracts concluded via the Store, in particular:
  • The Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended),
  • The Civil Code Act of 23 April 1964 (Journal of Laws 1964 No. 16, item 93, as amended),
  • The Act on Providing Services by Electronic Means of 18 July 2002 (Journal of Laws 2002 No. 144, item 1204, as amended),
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
  1. ORDERS 2.1. Orders may be placed 24/7 via the Store’s website or by email: sklep@dantor.pl or fhudantor@gmail.com. 2.2. Placing an order constitutes acceptance of these Terms and Conditions and the conclusion of a sales agreement in accordance with the law. 2.3. All prices in the Store are gross prices (including VAT). 2.4. Prices of custom-made goods are determined individually. 2.5. Each order is issued with a proof of purchase: receipt, VAT invoice, or VAT margin invoice. 2.6. Goods are dispatched within 3 business days from the order date. 2.7. Personal pickup is not available.
  2. FORMS OF PAYMENT 3.1. The Customer may pay:
  • by traditional bank transfer to the Seller’s account;
  • via the Autopay S.A. payment platform based in Sopot, ul. Powstańców Warszawy 6, 81-718;
  • cash on delivery – by cash or card to the courier (only for domestic shipments after setting up an account in the Store). 3.2. Available card payment methods:
  • Visa
  • Visa Electron
  • Mastercard
  • Mastercard Electronic
  • Maestro 3.3. Online payment processing is provided by Autopay S.A. 3.4. In the event of a refund for a transaction made with a payment card, the Seller will return the funds to the bank account linked to that card. 3.5. For payments made by bank transfer, electronically, or by card, the order processing time begins from the date the funds are credited to the Seller’s account.
  1. DELIVERY 4.1. Deliveries are carried out by courier services: DHL, FedEx, DHL Express, Poczta Polska, InPost. 4.2. The Store reserves the right to cancel an order in special circumstances without stating a reason.
  2. WITHDRAWAL FROM THE CONTRACT 5.1. The Consumer has the right to withdraw from a distance contract within 14 days of receiving the goods, in accordance with Article 27 of the Consumer Rights Act. 5.2. To withdraw, a clear statement must be sent by email to sklep@dantor.pl or by post. 5.3. The goods must be returned to: Dantor FHU Torba Waldemar, Wola Mała 106, 37-100 Łańcut, together with proof of purchase and the bank account number for the refund. 5.4. The refund covers all costs, including delivery costs (except additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard method offered). 5.5. The refund will be made no later than 14 days from the date of receiving the withdrawal statement. 5.6. Return shipping costs are borne by the Customer. 5.7. The Store does not accept cash-on-delivery returns or returns not previously agreed upon. 5.8. The right of withdrawal does not apply to custom-made goods, in accordance with Article 38 of the Consumer Rights Act.
  3. COMPLAINTS 6.1. The Customer is obliged to check the condition of the parcel upon delivery. 6.2. In case of damage or shortages, a complaint protocol must be drawn up and the Seller must be contacted immediately. 6.3. Complaints should be sent to: sklep@dantor.pl 6.4. The basis for the complaint is the proof of purchase and the complaint protocol (in case of transport damage). 6.5. Differences in shades (e.g. watch straps) are not grounds for complaint. 6.6. Complaints are processed within 14 days of receipt, in accordance with the Consumer Rights Act of 30 May 2014.
  4. PERSONAL DATA 7.1. The Seller is the controller of personal data. 7.2. Data is processed to fulfill orders under Article 6(1)(b) GDPR (contract), Article 6(1)(c) (legal obligation), and Article 6(1)(f) (legitimate interest of the Seller). 7.3. Details on data processing are available in the Privacy Policy accessible on the Store’s website. 7.4. The Customer has the right to access, correct, delete, and request the restriction of the processing of their personal data.
  5. FINAL PROVISIONS 8.1. From January 1, 2021, sole proprietors purchasing goods not directly related to their professional activity may benefit from consumer rights under Article 38a of the Consumer Rights Act. 8.2. In matters not covered by these Terms and Conditions, applicable provisions of Polish law shall apply, including the Consumer Rights Act, Civil Code, Act on Providing Services by Electronic Means, and GDPR.
